good morning. an early morning grass fire near highway 4 threatened a home. the reason firefighters were particularly concerned. a situation on the freeway right now where a man pulled over by police is actually scared to get back into his car. and the first cold front of the season is inching closer to the season. will that bring rain into the bay area? a 4th sexual assault situation in walnut creek. that story and more as the morning news continues.

topping our news this morning, police are in walnut creek despite an arrest over three previous attacks at the same location. all four assaults were reported at the parkregency.. we have jade hernandez with more on the reaction. >> reporter: about an hour ago, we poke to a -- we spoke to a woman who lives at the park regency. the news this morning worried her. >> i have an alarm on my door from the last round that we wept through. you know, i have a stick in my sliding glass door. i'm on the third floor. he has been going up to the third and fourth floors. >> reporter: the police are saying this was a home invasion where the woman was sexually assaulted. park regency used to have one

security guard on duty, but management hired a few more guards after the last of three assaults. they posted flyers warning residents about the incident in june. latest last night happened at 6:00 p.m. the woman told the sheriff's office that she was attacked in her apartment. the spoke man said the man followed the woman through the gates and followed her to her apartment and assaulted her. if the man is accused of three other assaults is still behind bars, who is responsible for the latest? >> i thought they caught the guy and it was all okay. i guess it is not. >> reporter: this is the man still behind bars in connection with the three other assaults at park regency. antonio mutan. his family and girlfriend claim he is innocent, but dna testing

linked mutan linked him to a rape this as you will r summer -- rape this summer. reporting live from walnut creek, jade hernandez, ktvu channel 2 news. investigators are looking for a cause of a fire in bay point. this happened at the bay point bart station. the winds whipped up and the fire crews put the fire out before the flames reached a nearby home. there are several new developments in the pipeline fire and explosion in san bruno. pg&e was worried liquids was corroding the pipelines including the one that blew up last week. doctors say the seven people burned in the pipeline disaster face a long and painful road to recovery. the smell of gas prompted evacuations yesterday in san

bruno and san francisco and oakland. the bullis family released a sad statement over the three loved ones still missing in the pipeline. the statement says, "it is with heavy hearts we announce the passing of levan and greg and william. it is with hope and love we wish to see this community rebuild." the funeral for the mother and daughter killed in the pipeline explosion will be held at st. cecelia's church in san francisco. last night, family members and friends gathered for a rosary service for jacklin and her daughter. the teenager was an 8th grader at st. cecelia's. >> she was the person that was a role model to everyone. i know all the kindergarteners looked up to her. i knew i could be like her.

>> she would walk down the hall and say hello to everybody. whether they were a kindergartener or 8th grader or teacher. >> more than 1,000 people packed the church for the vigil. the funeral service begins at 11:00 a.m. at the church on 17th avenue in san francisco. last night, family and friends gathered at the san bruno park remembering another victim of the tragedy. jessica morales was watching football with her boyfriend at the time of the explosion. the 20-year-old woman was killed. her boyfriend seriously burned. jessica morales' funeral will take place tomorrow night at the church of the highlands. the city of san bruno has declared a local state of emergency. that unanimous vote came last night during a special meeting at city hall. the declaration will release more state and federal assistance. city leader says the

devastating fire has changed san bruno forever. >> the situation has changed the community in ways that we probably don't yet even have the ability to perceive. >> last night's city vote follows the state of emerncy already declared by state lawmakers in sacramento. time is 6:06. a 19-year-old man is facing serious charges after leading chp officers in a chase in downtown san jose that killed two of his passengers. officers say they pulled over jose fernandez because of a missing license plate. when the officers got out of the patrol car, fernandez took off. he crashed into two parked cars a short time later at north 6th street. >> the end result was two passengers suffering fatal injuries. the front passenger and driver

suffered non-life threatening injuries. >> chp is investigating why fernandez pulled away. and the bay area's first toll express lane will be opened next week. it runs between highway 84 and highway 237 in milpitas. tolls will be collected using fastrak. solo drivers can access the lanes for $4 up to $6. if you have a trans ponder, you need to cover it up to avoid being charged. you can learn more information at ktvu.com. 6:08. the commute is just getting start for friday morning. sal, there has been a crash overnight? >> yes. i want to talk about this crash. a single car crash in san pablo overnight. three people were sent to the

hospital. the driver is in critical condition. the car jumped the sidewalk and slammed into the tree at barbara road at 1:30 in the morning. we don't know the conditions of the other two passengers. no official word on what caused the crash. the driver may have failed to negotiate a turn or maybe speed was a factor. one person in critical condition. let's go out and take a look at what we have on 80. you can see on 80 here -- there a car pulled over on the shoulder where a driver found a rat in his car. jumped out and he was freaked out. he waited for police to search the car with him. i would freak out, too. let's move along and take a look at the bay bridge toll plaza. coming into san francisco. getting all kinds of tweets about how the rat could have gotten in there. west 237 across 880.

welcome back. in afghanistan, extra security is in place ahead of parliamentary elections tomorrow. a united nations envoy says measures have been taken to take a stand over the issues that happened last year. voting materials were arriving by donkey with police escorts. the obama administration is now fighting back against critics who say its economic stimulus program is a waste of taxpayer money. the white house is releasing a list of its top 100 stimulus projects. we have alison burns live in the washington d.c. newsroom with that story. >> reporter: good morning. i just got a partial list from a white house official of the

top 100 stimulus projects that are changing the country and number five is the tunnel expansion. the feds have given the state $200 million for the project. it expected to alleviate traffic. california has been awarded $20 billion in recovery money. the white house is touting stimulus successes today as republicans step up the election season criticism of the spending. >> let's cut spending rather than continuing. >> reporter: the white house says the stimulus has created 750,000 jobs so far. the white house is going to be releasing the full list of the top stimulus projects in 45 minutes. i'll have it for you in the next update. reporting live from washington d.c., alison burns, ktvu channel 2 news.

we are following developing news from london where men were threatening the pope. the pope is on a four day visit to the u.k. today, he is in london. the pope was informed of the arrest and has not made any changes to his schedule. 6:16. a san francisco man has admitted to making threatening phone calls to house speaker nancy pelosi. a plea deal in federal court calls for 48-year-old greg jusi to stay away from pelosi and her family and staff when he is released fromprison.. jusi admitted to making more than 40 harassing phone calls to her home and offices. he is angry over her support for health care reform. this morning, government attorneys will ask to throw out a judge's order to release a guantanamo bay

prisoner who is accused of recruiting 9/11 hijackers. the federal judge ordered the release of the man in january. salahi. salahi was arrested in his home country in late 2001 and sent to guantanamo bay. the 9/11 commission report described him as a significant al-qaeda operative who instructed the september 11th hijackers. bart is now on track to expand to the oakland airport. yesterday, bart's board of directors awarded the contract to build the long delayed mass transit contract. the trains would run on the elevated tracks from the coliseum to the airport. it carries a $480 million price tag. sal, how does it look out there? >> we hope it stays friday

propose new rules this morning that could make it harder for financial firms to disguise their level of debt. it is to prevent the practice that led to the lapse of lehman brothers that allowed financial statements to appear stronger. the practice is illegal, but regulators say it can give a distorted picture of the debt and level of risk. good news from oracle. it posted better profits. the net income of $1.4 billion. that is up20%% from last year. research in motion posted a strong quarterly profit. time is 6:21. how about some hopeful signs about the state budget impact? >> the governor did not break out the sword and impale anybody. >> we will tell you how soon

all right. traffic is moving well if you are driving to the bay bridge. a bit of fog is the problem on the golden gate. steve and i will be back with the fog and traffic report in moments. thank you. this morning, the broken bp oil well in the gulf of mexico is a step closer to being permanently sealed. the next step is to pump mud and cement down the relief well to seal the broken well at the base. the final seal is expected to be completed by sunday. the state of california rejected a compensation claim by terry probyn. the state's problem to find her daughter created a nightmare that lasted 18 years. the state department of corrections says terry probyn should take her claim to the

courts and file a formal lawsuit. the state has already paid jaycee dugard $20 million. her mother was not included in the settlement. time is 6:25. at 11:30 this morning, state budget negotiations will resume in sacramento. last night, the governor and legislators met for three hours. that is the longest meeting they had in recent months. afterwards, there were signs an agreement may be near. >> a good session. we have a few more things to talk about and we are hopeful to be done tomorrow or the weekend. >> state lawmakers are now in record setting territory. today is the 79th day of the budget impasse. the longest they have gone without approving a spending plan. the stalemate is effecting thousands of non-profits all over the state of california. main cannot make their payrolls because they rely on state

money which has stopped. allied fellowship has not been able to pay its staff of 25 for two months. they provide temporary housing for parolees who have been released from prison. >> it is frustrating because you feel like you don't have a voice and no one is listening to you. there is no sense of urgency. >> so far, the state has more than $3 billion in overdue payments to social services and schools and local government agencies. another attack in the east bay. a woman is sexually assaulted at an apartment complex which previous attacks. why neighbors thought they were safe. and a recovery and clean up efforts continue in san bruno, the grieving process is under way. we will show you the outpouring of support from the community coming up. a big name in the bay area will give wall street a boost this morning. we will take you live to new york for the opening bell up next.

wearing my red. great cause. a great day. thanks to technology shares, oracle is helping wall street out. good morning. you made it to friday. i'm dave clark. >> i'm pam cook. wee have another sexual assault at walnut creek complex. it happened at the park regency on oak road. the suspect reportedly followed the victim through the gates and attacked her inside her apartment. three other women were attacked at the park regency apartments between june 30th and august 10th. but, 22-year-old antonio mutan remains in jail accused in the previous attacks. police say they have dna evidence linking him to at least one of the cases. mutan's family says he has been

falsely accused. our time is 6:31. we have a sad update to the search for victims of the san bruno explosion. the bullis family releasing a statement saying the remains of levan and greg and william were found in the home. we have claudine wong with what is being done to remember the victims. >> reporter: good morning. you know for days we have been out here in san bruno looking at the incredible damage behind us in the neighborhood. we have been so struck by the loss to the community and neighborhood. the greatest loss in all of this is the loss of life. the grieving today will continue with funerals for two of the victims. 44-year-old jacklin and her 13- year-old daughter.

there was a vigil at st. cecelia's in san francisco. more than 1,000 people came out to remember and mourn. friends describe jacklin as a devoted mother. they remember the girl as a role model who always had a smile on her face. they played this video of her confirmation. there was also a vigil last night for 20-year-old jessica morales. she was at home at the time of the blast watching a football game with her boyfriend. her boyfriend survived, but is in the hospital. last night, friends prayed for his recovery and they mourned jessica morales' loss. >> i could not go to sleep. i still have trouble sleeping. it is really hard. she was my best friend. >> reporter: funeral services for jessica morales will be held tomorrow. services for jacklin and her daughter will be held at 11:00

it happened at the contra costa theater in martinez. three people walked into the office and stole cash. the man is 6' tall and had short brown hair. he was wearing a dark blue zipper sweatshirt. we have an update on an officer-involved shooting in concord. police say the gun the suspect pointed at police during the foot chase was fake. two officers shot and wounded 25-year-old bryan brownwhite. investigators say he is wanted on a $900,000 arrest warrant for armed robbery. a gunman who opened fire on a car in antioch is still on the loose this morning. that shooting happened on summerville road at delta fair boulevard yesterday morning. the victim, a 34-year-old man from sacramento, was hit in the back, but he is expected to be okay. he told police that the suspect

good morning. welcome back. a quick look at some of the top stories we are following for you right now at 6:41. afghan president hamad karzai urging his president to vote in the parliamentary elections despite worries of violence. police have set up check poin to search for suicide bombers. the taliban has been warning people not to leave their homes. after five months, the oil well that spilled gallons of oil in the gulf of mexico is close to being plugged up once and for all. governor arnold schwarzenegger and other leaders meet again this morning on the overdue state budget. one said they could have an agreement by monday. hundreds of residents have been allowed to go back to their homes as fire crews are getting a handle on the forest

fire in the sierra. this wildfire has burned more than 100 acres in the kern river canyon. full containment is expected by sunday. one home was destroyed. hundreds more were threatened. investigators say the fire was caused by a human. it is not known if it is an accident or arson. a newspaper in egypt used photo shop to rearrange the positions of world leaders who are visiting the white house. look at the original photo. there is president barack obama leading other world leaders during the middle east peace talks at the white house. this, we are about to show you, is how the photo appeared in state run egypt newspapers. it featured the president of egypt up front. a seattle cartoonist has gone into hiding after a warning from the fbi. the cartoonist published an

illustration calling "everybody draw muhammad" day. the fbi told the cartoonist that a muslim cleric said she was a prime target. hurricane karl is gaining strength along the mexico gulf coast. it drenched cancun this week when it was a tropical storm. since then -- since then, it has grown into a category four hurricane. it could gain more strength before making landfall later today. clean up is under way in new york where a surprising and fierce storm tore through the city. the storm knocked over trees into roadways and killing one driver. rail service was knocked out for hours. the national weather service is now investigating whether that storm was a tornado. time is 6:44. police think a gunman was upset

about his mother's health before he shot a doctor and killed his mother and himself at johns hopkins hospital in baltimore. 50-year-old paul warren parris pulled out a gun and shot the surgeon once in the stomach. police say parris barricaded himself in his mother's room in the two-hour standoff. it ended when he killed his mother and then himself. it is a very surprising twist to this story about a washington state woman with acid burns all over her face. police now say she made up the whole story about somebody throwing acid at her. bethany storro said she disfigured her own face, but it is not clear why. the confession came after police spent hundreds of hours

investigating the case. uc region -- regents voted to increase pension contributions. people rallied outside the building in san francisco. the regents voted to increase what workers pay from 2% to 5%. the university also plans to increase the contributions from 4% to 10%. first lady michelle obama is denying the report that she told france's first lady that she did not stand life in the white house. a book about carla bruni stated that michelle obama could not stand the life in the white house. she said that is not correct. the book's author said the book
